Dodging the DUI is a possibility. But then again, from your description of the event, it's quite reasonable that the police is going to suspect DUI since he left the scene after a particular statement was said by the other party (in reference to th drinking). I'm also sure that if he's been drinking heavily that his behavior and speech would also reflect the infuence of alcohol. Now since time has passed, proper evidence cannot be obtained as to what his blood alochol content is at or around the time of his accident. Pushing the truck down a bank and claiming it stolen would also be difficult to prove since he spoke to the other party involved. He's already been identified by the other side so the stolen car story more than likely isn't going to fly. I'm not familiar with NY traffic laws but either case, he's looking at a number of possible charges. But some states consider it criminal, regardless of injury, to leave the scene of an accident. Your friend would be crying right now if that happened in Japan... lol. Japan now has a strict zero tolerance stance on drinking and driving. People found to have been drinking and driving are automatically taken to jail and fined somewhere in the neighborhood of $3000. And if your passengers are also found to be under the influence as well, an additional $2000 for each passenger is levied. I don't know what kind of jail time the law calls for here but a license suspension is essentially automatic until the issue is at least resolved in court.
